WELLINGTON, FL - November 6, 2008 - Phelps Media Group Inc., International, (PMG) a public relations firm based in Wellington, Florida, is pleased to announce that HorseClosings.com, LLC, a nationwide horse closing transaction business that serves buyers, sellers and professionals in the horse industry, is the newest member of the firm's client roster. Krysia Carmel Nelson, Esquire, and Tamara Leigh Tucker, Esquire, of Nelson & Tucker, PLC, are equine attorneys, lifelong horsewomen, and co-founders of¬ HorseClosings.com.
HorseClosings.com is the first known "equine closing" company that provides several programs to document the terms of horse sales and leases. It serves as a neutral company to "close" horse sales in a manner similar to real estate closing companies that finalize home and land sales. A recent demand in the equine industry and in various state legislatures for sales integrity and transparency in horse sales transactions inspired Ms. Nelson and Ms. Tucker to launch the business. ¬
"There has been a big push in the industry and several state legislatures to clean up the horse sales business," said Ms. Nelson. "People are suggesting that horse trainers be punished because they don't do paperwork in the same way a lawyer would - and that's not fair. HorseClosings.com provides a solution to the paperwork problem and many other issues associated with transparency in horse sales."
With HorseClosings.com, money paid by the purchaser of a horse is placed into an escrow account and disbursed along with the "HorseHUD-1"(C) and all necessary sales documentation. The HorseHUD-1(C) is the Horse Uniform Disclosure of Information Form that sets forth the purchase price paid by the buyer, the amount of commissions paid to all agents, the amount to be paid for insurance, other costs, if any, and the net amount to the seller. All parties sign off on the HorseHUD-1 so there is complete transparency in the transaction. HorseClosings.com holds the money in an insured escrow account so that there is no delay in the seller and agents receiving their money. Depending on the circumstances, transactions can be closed in one business day.
Four levels of services that cover domestic, international, and financed horse sales and leases are available.
As equine attorneys, Ms. Nelson and Ms. Tucker have dealt with many cases over the years that could have been avoided if a company such as HorseClosings.com had been available to the buyers, sellers, and professionals involved.
"I have seen all types of disputes arise from horse sales that were improperly documented and finalized," recounted Ms. Tucker. "Recently I had a client who sent her horse to a professional to be shown and sold. The horse was sold and the buyer paid the money directly to the professional, but because he was in debt, his bank account was frozen with the seller's money in it. Had the parties used HorseClosings.com, the money would have been paid by the buyer into an escrow account and disbursed along with the HorseHUD-1 and the transfer of ownership.¬ Now, the buyer has a horse that cannot be properly recorded with USEF and the seller may never get her money."
Krysia Carmel Nelson, Esq. earned her B.A. from Dartmouth College and her law degree from Villanova University. In private practice, Ms. Nelson represents leading horse owners, trainers, riders, breeders, equestrian facilities, major farms, clubs and associations across all nationally and internationally recognized disciplines. A frequent speaker at industry conferences, including the National Equine Law Conference, she also teaches at the Washington & Lee University School of Law in Lexington, Virginia.¬ A lifelong equestrian, she still competes regularly on the "A" show circuit in the amateur hunter divisions.
Tamara L. Tucker, Esq. earned her B.A. at Mary Washington College, graduating cum laude, and earned her¬ J.D. from the University of South Carolina School of Law. In addition to her business and insurance law practice, Ms. Tucker handles dozens of equine law cases annually. In recent litigation, she received a verdict on behalf of a defendant farm owner in a $1 million premises liability action; a verdict on behalf of the plaintiff horse owner in a breach of contract claim; and a settlement on behalf of a policyholder in an equine mortality coverage case involving a $500,000 broodmare. Ms. Tucker regularly shows in the amateur hunter divisions with trainer Tommy Serio and has garnered tricolors at "A" and "AA" shows throughout the east coast.
